When is an expert opinion required?

An expert opinion is an in-depth analysis conducted by an independent expert in response to a dispute. A court expert is used in a variety of situations:

  • The court may appoint a court expert in civil and criminal cases. The parties involved can suggest an expert themselves, but the court is not obliged to accept this suggestion.

  • Parties may agree among themselves or contractually to appoint an expert should a dispute arise. In this case, the expert acts as an independent expert.
  • A party may appoint its own expert or technical counsel to defend its interests.

As the first step within an investigation, a kick-off meeting is organized. Together with the expert, the parties involved discuss the assignment and positions.

Then the court expert draws up a summary list of all the information that the parties involved must provide. This may include, for example, financial statements, balance sheets and income statements for the past few years, or an overview of outstanding debts and receivables.

Based on this information, the court expert writes a preliminary report with his initial decisions. Parties are given the opportunity to provide feedback and additional information. The court expert processes the parties’ input and produces a final report. This provides the judge with a response on the technical side of the dispute.
